Terms & Conditions

1. Definitions

For the purposes of these Terms:

  • Company refers to Boost3PL, Inc., located at 4201 Tonnelle Avenue, North Bergen, NJ 07047, USA.
  • Website / Site means https://www.boost3pl.com, owned and operated by the Company.
  • User Agreement means these Terms of Service.
  • Customer means any individual or legal entity that uses the Site, accepts these Terms, the Warehouse Storage Conditions, and uses the Company’s services.
  • Manager means a Company employee responsible for communication and coordination with the Customer.
  • Buyer means any individual or legal entity purchasing goods from the Customer.
  • Services means logistics, warehousing, shipping, forwarding, and related services provided by the Company.
  • Warehouse Storage Conditions means the terms governing storage of goods at the Company’s warehouse, available on the Site.
  • Amazon means https://www.amazon.com.
  • U.S. Marketplaces means online sales platforms operating within the United States.
  • Transport Carriers means freight forwarding and courier companies including, but not limited to, USPS, FedEx, UPS, and DHL.
  • HS Code means the Harmonized Commodity Description and Coding System code.
  • Forwarding Parcels means acceptance and immediate shipment of Customer goods to Buyers.
  • Google Sheets refers to https://docs.google.com/spreadsheets.
  • Goods Buyback Procedure means the addendum governing buyback services, available on the Site.

2. General Provisions

The Company provides the following services:

  • Acceptance, inspection, packaging, repackaging, and storage of goods
  • Shipment of goods to Amazon and other U.S. marketplaces
  • Shipment of goods to Buyers within the U.S. and internationally
  • Forwarding parcels domestically and internationally
  • Goods buyback services on Amazon and other U.S. marketplaces
  • Current service pricing is available at: https://www.boost3pl.com/pricing
  • Goods Buyback services are governed by the Goods Buyback Procedure.
  • These Terms constitute a public offer. By accessing the Site, registering, or providing any personal data, the Customer accepts these Terms and the Warehouse Storage Conditions.
  • The Company may modify these Terms at any time without prior notice. Updated Terms become effective upon publication on the Site.

3. Customer Obligations

The Customer agrees to:

  • Review and comply fully with these Terms and Warehouse Storage Conditions
  • Provide accurate and complete registration and goods information
  • Maintain updated goods data via Company-approved tracking tools
  • Specify repackaging requirements in advance
  • Reimburse all customs duties, taxes, and related fees paid on their behalf
  • Comply with all U.S. laws, international laws, and intellectual property regulations
  • Avoid using the Site or Services for illegal, restricted, or prohibited goods
  • Refrain from copying or using Site content without written permission

Failure to comply may result in suspension or termination of services.

4. Company Obligations

The Company agrees to:

  • Store goods in accordance with Warehouse Storage Conditions
  • Notify Customers of accepted quantities and discrepancies
  • Package goods as requested
  • Ship goods after full payment for services
  • Maintain confidentiality of Customer data, except as required by law or these Terms

5. Customs Duties and HS Codes

  • HS Codes may be provided by the Customer or the Company.
  • Customs authorities may require changes to HS Codes, which may affect duty rates.
  • Duties and taxes are initially paid by the Company and reimbursed by the Customer.

6. Liability and Responsibility

  • Services and Site content are provided “as is” without warranties
  • The Company is not responsible for losses arising from Site use
  • The Company is not liable for actions or failures of transport carriers or sellers
  • The Company may involve third-party service providers as needed
  • Misidentified or unclaimed goods may be disposed of after 14 calendar days

7. Personal Data

  • By using the Site and Services, the Customer consents to the collection, processing, storage, and transfer of personal data for operational and legal purposes.
  • Personal data may be shared with logistics providers, marketplaces, financial institutions, and other service partners as required.
  • The Company implements reasonable safeguards to protect personal data.

8. Term and Termination

  • These Terms are effective upon publication
  • Either party may terminate with 30 days’ written notice and settlement of all outstanding invoices
  • Invalidity of one provision does not affect others

Governing Law and Dispute Resolution

All disputes shall first be resolved through negotiation. If unresolved, disputes shall be governed by the laws of the State of New Jersey, USA, and resolved in New Jersey courts.

Goods Buyback Procedure

(Addendum to Terms of Service)

This Goods Buyback Procedure governs buyback services provided by Boost3PL and supplements the Terms of Service.

1. Scope

The Company may, upon Customer request, purchase goods from Amazon or other U.S. marketplaces, receive them at its warehouse, and forward them to the Customer.

Submission of a buyback request constitutes acceptance of this Procedure, the Terms of Service, and Warehouse Storage Conditions.

2. Buyback Process

  • Customer submits a buyback request via Company-approved tools
  • Request must include product details, quantity, links, delivery address, and applicable promo codes
  • Company issues an invoice covering product cost, service fees, and expenses
  • Services commence after full payment
  • Goods may be repackaged if requested

3. Returns

  • Return services are optional and billed separately
  • Customer is responsible for understanding seller return policies
  • Refunds received by the Company are transferred to the Customer promptly
  • Service fees are non-refundable if the seller refuses the return

4. Responsibilities

  • Customer is responsible for accuracy of all provided data
  • Company is responsible for goods only while stored in its warehouse
  • Visual inspection does not guarantee detection of defects

5. Termination and Disputes

  • This Procedure remains effective until terminated with 30 days’ written notice
  • In case of conflict, this Procedure prevails over the Terms of Service
  • Governing law and jurisdiction remain the State of New Jersey, USA
